Terms of service

These terms govern your use of Flood Zone API (the "service"), provided by CHM Capital Ltd, registered in England and Wales, company number 17466915, registered office 59-60 Russell Square, London WC1B 4HP ("we"). By creating an account or using an API key you agree to them.
1. The service
The service returns information from the Federal Emergency Management Agency's National Flood Hazard Layer (NFHL) for a location you supply, together with geocoding by third parties. FEMA's data is a US Government work; we do not own it and FEMA does not endorse the service.
2. Informational use only
Answers describe what FEMA's effective map shows at a point. They are not a Standard Flood Hazard Determination, a flood certification, a prediction of flooding, an insurance quote, or professional, legal or engineering advice, and they do not reflect Letters of Map Amendment for individual structures. Geocoding places addresses approximately. You are responsible for how you use answers and for any decision based on them, and you must not present them to others as a flood determination.
3. Accounts and keys
You must give a working email address and keep your API keys confidential. You are responsible for calls made with your keys. Revoke a key on your account page if it may have been exposed.
4. Plans, billing and cancellation
Paid plans are billed monthly in advance through Stripe at the price shown on the pricing page when you subscribe. Each plan includes a number of calls per calendar month (UTC); unused calls do not roll over, and calls beyond the quota are refused rather than billed. You can cancel at any time in the billing portal; the plan then runs to the end of the period you have paid for. Except where the law requires otherwise, payments are not refunded for partial months. If we cannot provide the service for reasons within our control, contact support and we will make it right, which may include a refund.
5. Acceptable use
Do not share keys to get around quotas, open several free accounts for one project, resell raw access to the API as your own API, attempt to break or overload the service, or use it unlawfully. We may suspend keys that do. You may use and display the answers inside your own products.
6. Availability and changes
The service depends on FEMA and on geocoding providers that we do not control, and it may be unavailable at times. We offer no service level agreement. Within API version 1 we add fields but do not rename or remove them; we will give account holders at least 30 days' notice by email before retiring a version.
7. No warranty
The service and its answers are provided "as is" and "as available". To the extent the law allows, we give no warranty that answers are accurate, complete, current or fit for a particular purpose.
8. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill, and our total liability arising from the service in any 12 months is limited to the amount you paid us in those 12 months. Nothing in these terms limits liability that cannot be limited by law.
9. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except that if you are a consumer you keep any protections of the law where you live.
10. Changes to these terms
We may update these terms. We will change the date above and email account holders about material changes at least 14 days before they apply.
